I know the Code of Ethics training is mandatory, but I’m pretty busy and can read the code on my own. Isn’t there a waiver that I can sign that says I read it? What happens if I just don’t take the mandatory training?
There is no waiver that will get you out of taking the Code of Ethics training, and there are no extensions. The deadline for completing the training is Dec. 31, 2004.
If you don’t take the training by the deadline, your membership in your local, state, and national associations of REALTORS® will be suspended. That means you cannot receive services and benefits (like MLS privileges, access to ZipForm, magazine subscriptions, etc.), and cannot use the term REALTOR® during the suspension.
I’m “grandfathered in” and don’t have to take any additional education, so I don’t have to take this course, right?
The only grandfather clause that relates to this training is for members who took training that meets the course requirements following the 1999 NAR Convention but prior to Jan. 1, 2001. Those members are considered to have satisfied the requirement for the current four-year period, but will need to take the course during the next four-year period. You may be thinking of a grandfather clause relating to MCE required for maintaining a real estate license. That is completely separate from Code of Ethics training.
I became a REALTOR® last year and took a Code of Ethics course then. Do I have to take another one before the end of this year?
No. Anyone who took the New Member Code
of Ethics Training since Jan. 1, 2001, does not
need to complete additional ethics training until
the four-year cycle that goes from Jan. 1, 2005 -
Dec. 31, 2008.
I’m an appraiser. Do I have to take the training?
Certified licensed appraisers must join the association as REALTOR® members. All REALTORS® must take the training, so, yes, you must complete the course prior to the deadline.
Do I have to take ethics training even if I’m a commercial broker?
Yes. All REALTOR® members must take the course. While commercial members can take any course that satisfies the requirement, you may be interested in an online course NAR designed specifically for commercial practitioners. The course includes case studies developed by the CCIM Institute.
Where do I take the training?
There are many sources. You can find an online course provided by NAR at Realtor.org. Many
local associations and proprietary schools also
offer courses. And you can purchase a video
course from TAR.
Does this course count for MCE?
The training can count toward mandatory continuing education required for your Texas real estate license, but it depends whether the course you take is approved by TREC and meets all other TREC requirements. If you want the course to count for MCE, verify before you begin that it will.
Who tracks whether I’ve taken the course?
It’s up to the local associations to ensure that members comply with this policy.
What happens if the association does not track
and ensure compliance?
The association could lose its NAR-provided professional-liability insurance coverage, and
the association’s charter as a member board of
the National Association of REALTORS® would
be at risk.
