Here are some procedures that should assist you in preventing complaints being filed:
• Know the law. Be aware of your duties and obligations as an agent. Most licensees that TREC investigates are not aware of the laws that have been broken.
• Discuss tricky situations with your broker. He can offer advice and often has policies and procedures to handle certain situations.
• Keep thoroughly documented records. Record dates of meetings, contract signings, or meetings with clients. This can prove invaluable in defending yourself against a complaint.
• Keep copies of important documents. Even though there is no legal requirement in TRELA for agents to maintain records, a complainant has four years from the date of the transaction in which to file a complaint. Some people actually wait a year or more before filing a complaint.
