Legislative clarification

With regard to the Legislative Review article found in the July 2001 Texas REALTOR®, please note the following:

  1. HB 1514, concerning the operation of certain commercial enterprises that constitute a nuisance, was vetoed by the governor.
  2. The article reported that SB 507, concerning property owners’ associations, gives the owner a 90-day right to redeem a property foreclosed upon by the POA. The bill’s final version provides a 180-day right of redemption.
  3. The article reported that REALTORS® who call potential buyers are exempt under HB 472, concerning telemarketers. The bill’s final version provides an exemption for a state licensee if: the call is not made by automated means; the enlistment of services is not completed until a face-to-face meeting with the licensee, and the consumer does not have to pay anything in advance; and the consumer has not requested that the licensee not call.
